Notice of Election

All members of Mine Mill/CAW are automatically nominated for all positions for which you qualify and to conform to Local Union By-Laws. If you wish to accept the nomination, you must indicate your intention in the manner prescribed (A separate poster will follow indicating positions open for election). Nominations will be open on Sunday March 15th and close on Wednesday, April 3rd, 2009 at 5:00 p.m. Qualifications will be accepted by the Union secretary, in person or by fax, followed by a phone call to confirm identity. Qualification forms will be available at the Union Hall and at the workplace from Chief Stewards, Unit Chairs, and Health & Safety Offices. With the filled out Nomination/Qualification form if you wish you can submit your article and picture to be printed in a special edition of the Election Newspaper that will be printed prior to the Election. The deadline for newspaper article submission is Wednesday, April 3rd, 2009 at 5:00 p.m. Late submissions will not be accepted!
Eligibility

No member shall be eligible to hold Executive office who has not been a member in good standing for at least one year prior to nomination. To be eligible to run for Stewards and Committee persons it is six months. To be eligible to run for CAW Constitutional Convention, a member must have been in continuous good standing in the National Union for (12) months immediately preceding the first day of the month in which the Convention is held and shall have been member Mine Mill Local 598/CAW for three (3) months. The 12-month rule does not apply to Units who recently joined the CAW, but the 3-month Mine Mill Local 598/CAW rule does apply.
Election – May 2009

Polls will be set up at each worksite (except First Nickel and NORCAT) and at the Union Offices. Members can vote at the Union Hall any time that polls are open. Dates and times of voting will be announced in a special election edition of the Mine Mill News prior to the election. Those Mine Mill Local 598/CAW Units with signed Collective Agreements will have the opportunity to run and/or vote for Executive Officers and for workplace representatives and these units are: Xstrata Nickel, Finlandia Care Services, Iris Addiction Recovery, University of Sudbury, Mansour Mining, Elizabeth Centre, Finlandia Nursing Home, St. Joseph’s Villa, Mystik Services, Nutra 2000, Slots at Sudbury Downs, Copper Cliff Manor, Midas Car Care and Lafarge Construction Materials. Those Mine Mill Local 598/CAW Units that don’t have signed contracts with their respective employer and our Pensioners will have the opportunity to vote for Executive Officers only. When the Units have a signed Collective Agreement, we will then administer elections for workplace representation according to the provisions of that Collective Agreement. This Unit is NORCAT. First Nickel has a living contract and therefore members are entitled to run and/or vote for Executive Board members only.
Advance Poll

An advanced poll will be set up at the Union offices at 19 Regent Street on Wednesday, May 6th from 9 a.m. to 8 p.m. to accommodate those finishing day shift and those that work night shift and will not have access to the polls on Election Day. This will include those members who by reason of vacation, jury duty, bereavement leave, leave of absence, union business, WSIB, sickness or other known and foreseeable reason or unavoidable circumstances who will not have access to the regularly scheduled election polls.
Run-off Election

Where a candidate for Executive office does not receive a clear majority (50% plus one of ballots cast) there will be a run–off Election the following week, on dates to be announced (a separate poster will be issued for that purpose). The Local Union must elect three Trustees at the same time. Where there are less than seven (7) candidates, the three (3) candidates receiving the greatest number of votes shall be declared elected. Where there are seven (7) or more candidates, the majority point is determined by adding the total valid ballots cast for the office of Trustee, divided by the number of positions to be filled (which is three (3)), again dividing by two (2), which will determine the 50% mark, and then adding one (1) to determine the majority point). In the event that more than three (3) candidates receive a majority vote, the three (3) candidates with the greatest majority shall be declared elected.
CAW Constitution is the Law of Our Union

It guarantees basic trade union rights to all members. It is intended to protect equally the rights of all members and of the Union as a whole. The most important of these trade union rights is the right of the membership to a fair and democratic procedure in all instances when they vote to choose their officials. In order to guarantee this right, the CAW Constitution provides basic regulations for the conduct of elections for the Local Union Office, Convention Delegates, Stewards and Committeepersons. We feel this information is necessary for those members who are not familiar with Union functions. Be proud to belong to Mine Mill Local 598/CAW. Stand up for your rights! Get involved! Executive position OLG rules

All members of Mine Mill Local 598/CAW who wish to run for Executive Board positions have to comply with Terms of Registration with Alcohol and Gaming Commission of Ontario.

In particular, Section 32 (1) 9 of this regulation prohibits the operator of a gaming premises from allowing executives and staff of a trade union who represent or negotiate on behalf of gaming employees at the gaming premises to play games of chance at that gaming premises. The signed terms on CAW Canada Local Union 598 o/a Sudbury Mine, Mill and Smelters Workers registration also require its executives to ensure that these individuals refrain from such gaming activities.

Please be also reminded that the terms of registration for CAW Canada Local Union 598 o/a Sudbury Mine Mill and Smelters Workers require its executives to provide the Deputy Registrar with written notification of its intention to change any member of its executive, and to obtain the Deputy Registrar’s written consent prior to the change.

Please note that should any other executive or staff member of CAW Canada Local 598 o/a Sudbury Mine, Mill and Smelter Workers wish to deal directly with any gaming premise in Ontario, they must first submit a fully completed Personal Disclosure Form, with finger prints and photographs to the Commission and be approved by the Deputy Registrar.

Positions open for Election

Mine Mill members at Xstrata Nickel can vote and/or run for Executive Officers (President, Vice President, Three Trustees, Guide, Sergeant-At-Arms, Financial Secretary, Recording Secretary), Unit Chair, Compensation, Health & Welfare Officer, CAW Council and Convention delegates (runners-up for delegates shall be alternates in order in which they finished).  Bargaining Committee members are the Chief Stewards.   • Important Note for Xstrata Nickel Unit

    According to our By-Laws, Chief Stewards and Stewards are elected on a separate ballot.  The same applies to Full-Time Health and Safety representative and members (where applicable).

    If you win both positions, i.e., Chief Steward & Steward, the remaining positions of Stewards will be filled in order of votes received (plurality rule). This same rule applies for elected full-time Health and Safety representative and Health and Safety Committee persons.

    If a member gets elected as full-time Health and Safety Representative and Committee Person, the elected full-time Health and Safety Representative will automatically be deemed a Committee Person and Chairperson. Candidates will fill the remaining Committee positions based on the highest vote received.

    “A member in good standing can not run for more than one (1) position on the Executive Board or more than one (1) full-time position. He/she may also run for a site position(s) in addition to an Executive Board position. If elected to more than one (1) position, he/she can hold those positions provided they do not conflict.”

    “To be eligible to run for Stewards and Committee Persons, a person must be a member for at least six months prior to nomination.”

    The number of CAW Convention and Council delegates will be distributed among the Units when they become available according to the allocation formula.

    Please note that anyone elected to any position in an interim election or after the signing of a collective agreement, that position is only valid until the next tri-annual general election.
